What happens if I send my application form without all of the relevant information?

Incomplete applications will not be accepted and will be returned to you. Consumer Affairs and Fair Trading will not commence to process your application until it is completed and accompanied by the correct documentation. It is your responsibility to ensure that you have provided all necessary information set out in the checklist of your application form. You should note that you are not permitted to work in the industry until you have obtained your licence.

Is there an age limit to obtaining a licence?

You must be 18 years of age before you can apply for a licence.

How much money do I send with my application?

The full licence fee is to be lodged together with your completed application form.

For Employee application forms the fee is $133.00

For Agent application forms the fee is $605.15

How long after I send in my application will it take before I get my licence?

If you have correctly completed your application form and there is no criminal history recorded against you, you may expect to receive your licence within 6 weeks. If an incorrect application was lodged or there is a requirement for further investigation, delays may be experienced and the time extended.

There are 3 basic steps in processing an application.

 

Step 1 – Applicant completes and lodges form with required documents

 

Step 2 – A copy of the application is sent to Tasmania Police (under section 7 of the Act) for him to comment if he has an objection to the licence being issued, this stage can take anywhere from 2 to 6 weeks.

 

Step 3 – Letter is received from Tasmania Police, then Consumer Affairs makes decision on application, if no objections raised 2 to 3 day processing time by Consumer Affairs.

Do I have to complete any training when applying for a licence?

To hold a licence to undertake security or crowd control duties you are required to complete two prerequisite units before you make application for a licence.

To hold a licence to undertake inquiry or commercial or commercial sub-agent activities there are no prerequisite training requirements.

Please see the Approved Units of Competency for training requirements and the list of Registered Training Providers who are eligible to provide this training.

The only documents that will be accepted for recognition of your qualifications and experience will be:

  • a Statement of Attainment from a registered training provider, if you have completed a course dated no older than 1 January 2006
  • a Certificate of Equivalency from a registered training provider verifying that they have recognised other qualifications and experience that you have, as being the equivalent of the required accredited course.

I have completed a course before the 1 January 2006 is that training certificate ok to use?

This Office will accept statements of attainment under the Security Operations, Investigative Services and the Financial Services certificates if they were issued after the 1 January 2006, providing that the statements of attainment comply with the training requirements previously required. Statements of attainment issued before this date will no longer be accepted, and applicants who hold statements of attainment issued before January 2006 will be required to comply with current training requirements.

What is the term of my licence?

Employee licences are issued for a period of one year

Agent Individual and Body Corporate licences are issued for a period of three years.

How do I find a training provider?

Do I have to declare my offences on my licence application?

Yes, you will need to complete the suitability section of your application form and meet criteria outlined in Section 8 of the Security and Investigations Agent Act 2002.

Failure to declare any offences on your application may result in your application being refused and/or you may be charged with an offence.

Do I need a police report when lodging my application form?

Yes a police report is required however instead of requesting and waiting for the national police certificate and then lodging the application for a licence with this office. You may now complete and lodge the request for a national police certificate (the request form is attached to the back of the application) at the same time as lodgement of the application for a licence. You need to make a note on the application form that you have request the police report.

Tasmania Police have been requested to send the certificate directly to this office. This report may take up to six weeks to be received.

Must I wear my photo licence?

Yes. The photo licence must be worn and clearly visible at all times when carrying out security activities unless a written exemption has been granted the Commissioner. Applications for exemptions will only be considered from Agent Licence holders, who can demonstrate their employees are engaged in loss prevention, transport of cash and/or valuables and in plain clothes for covert reasons.

What happens if I lose my photo licence?

If you have lost your licence you should report the loss immediately to the Security Helpline, in case it has been handed in to the office. As you are unable to work without displaying your licence, you should complete an “Application to amend registered details” form and lodge at Service Tasmania.

Am I eligible to work in the industry without a current plastic licence?

It is an offence to work or operate within the industry without holding a current plastic licence that authorises those activities.

What should I do if I have not received my re-application notice?

If you are a current licence holder, you will receive a pre printed re-application form in the post approximately eight weeks prior to the expiry of your current licence.

If you do not receive the notice four weeks before expiry, you should contact the office to confirm your current address and, if necessary arrange a reprint of your re-application notice.

When you receive your re-application, you should lodge the completed form and supporting documentation to Service Tasmania at least 30 working days before the expiry date of your licence.

A pre-printed re-application notice cannot be issued if a person has a conditional/provisional licence. If you have a conditional/provisional licence you must supply a copy of your completed training certificates at least 3 months before the expiry date of the conditional/provisional licence, so a pre-printed re-application notice can be provided by this Office.

I have recently moved, how do I inform you of my change of address?

Do I need a first aid certificate?

Those who undertake security and crowd control activities are required to hold a current first aid certificate. You must supply a copy every time you make reapplication, even if it is the same certificate or statement of attainment you lodged the year before. Lodging the form without a first aid certificate can result in a delay with processing your application.

A first aid certificate is only valid for 3 years. If first aid is a unit on your statement of attainment in security this is still only valid for 3 years and the date will be taken from the issue date of the statement of attainment. Example: The statement of attainment was issued 23 August 2006, the first aid unit is only current to 23 August 2009.

First Aid accepted is a Workplace Level 2 certificate (eg from red cross), or from the previous training the unit PRSS0327 form Certificate III in Security Operations, PRSS0206 from Certificate II in Security Operations or the HTLFA301B unit from the current training package.

How do I inform my change of a name change?

Consumer Affairs and Fair Trading MUST be notified of your new name within 30 days. You need to complete an “Application to amend registered details”

You must provide a certified copy:

  • change of name certificate issued by the Register of Births, Deaths and Marriages, or
  • a marriage certificate.

Can I appeal if my licence application is rejected?

Yes. If you are unhappy that your application has been rejected, you need to write and request a statement of reasons within 28 days.

On receipt of the statement of reasons for the decision you have the right to apply to the Magistrates court (administrative appeals division) for a review of the decision within the prescribed period.

Can my licence be cancelled during its validity period?

Yes. If a licence holder is found to undertake, or have undertaken, any activity that creates doubt about their suitability to hold a licence, then their licence can be cancelled. This means the licence holder is not able to work in the industry in Tasmania.

I have a licence in another state of Australia and what to work in Tasmania. Do I need a licence in Tasmania?

Yes. If you have a licence in another state or territory, you are eligible to apply for a licence in Tasmania under 'Mutual Recognition' laws, provided the licence authorises you to perform the equivalent activities.

Why doesn't my interstate licence cover me in Tasmania?

You cannot work in Tasmania using your interstate licence. As with driver’s licenses and road rules, each state maintains jurisdiction over their own licensing. Regulation is through the respective state governments and their relevant legislation. Because of the differences in legislation, each state requires that a licence must be issued under their jurisdiction to authorise employment within the industry.

I am now no longer the manager for an employee licence holder what do I do?

If you are no longer the manager for an employee licence holder you need to advise us. All you need to do is put in writing that (the person name & licence number) is no longer employed under your licence and the dated this came in to effect.

I lost my receipt and need another for taxation purposes?

Applications are lodged through Service Tasmania, at the time of lodgement you are issued a receipt, if this is misplaced and you require another you would need to enquire at Service Tasmania, as this is where payment was made. The office of Consumer Affairs can not reissue you a receipt.

I have an employee security guard / crowd controller licence do I need a bankruptcy report when making application?

No, you only need to obtain a bankruptcy report if you are an Agent licence holder (security agent, crowd control agent, inquiry agent, commercial agent) or hold an Employee licence with the activity of commercial sub-agent.

How soon should a lodge a reapplication form?


A reapplication form should be lodged 30 working days before expiry date (example licence expires 15 Dec application should be lodged no later than 3 Nov) lodging a form inside the 30 day period increases the risk that your old licence will expire before a new licence is issued.

I lodged my reapplication form can I keep working as the expiry date on my old licence has passed?

 

No.

 

Lodging a form and receiving a receipt does not mean you are authorised to continue working, once a licence has expired, the authority to undertake licensed activities is withdrawn and you can not recommence work until you have received your new licence.
