Residential tenancy reform proposals 

 

In December 2011, the Minister for Corrections and Consumer Protection, the Hon Nick McKim MP, released a Final Report and Consultation Paper for the Residential Tenancy Act review which contained a series of recommendations for changes to residential tenancy law in Tasmania.

 

The Minister invited submissions from property owners, tenants and other interested persons on the range of issues covered in the paper.

 

The paper includes recommendations relating to:

  • certainty of tenure;
  • rent increases;
  • rent bidding;
  • standards of accommodation;
  • dispute resolution;
  • maintenance and repair obligations; and
  • water efficiency.

 

Written submissions closed on 24 February 2012.  Close to 200 submissions were received from tenants, property owners, community organisations and other interest groups. More than 40 detailed submissions were received.

 

As expected, there were a range of views on different proposals however there was significant support for

  • the introduction of minimum standards of accommodation;
  • expanding the powers of the Residential Tenancy Commissioner to resolve a wider range of disputes;
  • prohibiting rent bidding; and
  • clarifying and improving maintenance and repair obligations under the Residential Tenancy Act.

 

Submissions

 

Some respondents have provided permission for their submission to be made publicly available.

Submissions will be considered against the draft proposals before recommendations are made to the government.  A reference group has been established to provide input to the review and there will be further opportunity for stakeholder input to the project through this forum.  It is anticipated that legislation to implement the outcomes of the review process will be introduced into Parliament later in 2012.

Smoke alarms in residential rental properties - submissions invited

 

The Minister for Corrections and Consumer Protection, the Hon Nick McKim, MP invites comments from property owners, tenants and other interested persons on the:

 

The draft bill and regulations require that residential rental property owners ensure that smoke alarms are in place in their rental properties while they are tenanted under a residential tenancy agreement.

 

Detailed requirements contained in the draft regulations include:

  • the class of premises required to have smoke alarms;
  • the type of smoke alarms required; and
  • the location of alarms in premises. 

 

The draft regulations also include maintenance, testing and cleaning obligations for property owners and tenants.

Comments on the draft legislation will be considered in finalising the legislation for Cabinet approval and introduction into Parliament.
