Boarding Premises

You are renting a boarding premise if:

  • You rent a specific room in a premise

  • You share facilities (e.g. kitchen, bathroom)with other tenants

You are renting a share house if:

  • One person (head tenant) rents a property and sublets rooms to one or more people, or

  • You jointly sign a lease for a property with another tenant(s)

  • Which room you take and how much rent you pay - is agreed with the other tenant(s)

Boarding premises can occur in a traditional boarding house where a meal and linen service may also be supplied. However they may also occur in a normal house, hotel or hostel.

If the owner lives on the premises and rents out only one or two rooms it is neither a share house nor a boarding premise and the Act does not apply.
