A prepaid funeral is:
where funeral arrangements are predetermined;
a contract is signed; and
money is paid in advance.
The Prepaid Funerals Act 2004 requires:
- funeral businesses to provide you with certain information before you enter into a prepaid funeral agreement; and
- any money paid to a funeral business to be paid into a funeral trust and specifies how this money is to be managed by the funeral business.
It is recommended you seek independent legal advice before entering into a prepaid funeral plan.
Requirements for prepaid funeral businesses
A funeral trust must be approved by the Director of Consumer Affairs and Fair Trading. The Director maintains a Register of approved funeral trusts. Complete an Application for Approval of a Funeral Trust [pdf 57kb / 2 pages].
- The Act establishes reporting requirements that funeral businesses must meet each year.
- Consumer Affairs and Fair Trading mails an Annual Return to each registered funeral business to be completed and returned before 31 December each year.
