Renewal Procedure

To renew a Bill of Sale you need to complete the renewal form Statutory Declaration for Renewal of Registration of a Bill of Sale, and attach the following information:

  • the full name and residential address of the individual making the declaration;
    the bill of sale registration number;
  • the date the bill of sale was previously registered;
  • the full name and residential address of the grantor/s (or borrower/s) - please note that a post office box address will not be accepted for a grantor;
  • the full name and residential address of the grantee/s (or lender/s - a post office box will not be accepted;
  • the amount presently secured; and
  • the statement at the end of the renewal form which should be completed by the individual making the declaration and signed before a Justice of the Peace or Commissioner for Declarations.

A bill of sale may only be registered in the name of an individual, a Pty Ltd company registered with ASIC or a registered Association.  A bill of sale cannot be registered to a business name or family trust.

Please ensure the declaration is sworn under the correct Act.  In Tasmania this is the Oaths Act 2001.  If the declaration is sworn outside of Tasmania, you will need to check with the relevant State Authority.

Lodging

Business Affairs does not notify you when a bill of sale is due for renewal.

Documentation to renew a bill of sale should be lodged at Service Tasmania or received by Business Affairs prior to expiry.

If you wish to renew a bill of sale that has expired, you have two options:

  1. apply to the court for an extension of time; or

  2. re-execute the Bill of Sale i.e. complete a new statutory declaration and have the bill of sale re-registered.

Cost

The prescribed fee, made payable to the Business Affairs Branch, must be paid when lodging the renewal form.

Acknowledgement of Renewal

Business Affairs does not send notification that a bill of sale has been renewed.

If you require for your records the new bill of sale number and renewal date, please include the original bill of sale when lodging the renewal form statutory declaration.

After renewal we will return to you the original bill of sale contract stamped with a new bill of sale number and registration date.
