Registration Procedure

To register a Bill of Sale you need to complete the registration form Statutory Declaration Verifying Particulars of a Bill of Sale, and attach the following information:

  • the full name and residential address of the individual making the declaration;
  • the date of execution;
  • the full name and residential address of the grantor/s (or borrower/s) - please note that a post office box address will not be accepted for a grantor;
  • the full name and residential address of the grantee/s (or lender/s - a post office box will not be accepted;
  • the amount secured; and
  • the statement at the end of the registration form which should be completed by the individual making the declaration and signed before a Justice of the Peace or Commissioner for Declarations.


A bill of sale may only be registered in the name of an individual, a Pty Ltd Company registered with ASIC or a registered Association.  A bill of sale cannot be registered to a business name or family trust.

Please ensure the declaration is sworn under the correct Act.  In Tasmania this is the Oaths Act 2001.  If the declaration is sworn outside of Tasmania, you will need to check with the relevant State Authority.

The original bill of sale contract should be attached to the registration form.  The contract should include details of the goods (chattels) to be covered by the bill of sale including any relevant serial, vehicle identification number (VIN), and/or registration numbers.

Lodging

In accordance with Section 5 of the Bills of Sale Act 1900 a bill of sale must be lodged at Service Tasmania or received by Business Affairs within 21 days of the date of execution.  If documents are received outside this period they become null and void, and must be re-executed for any legal effect.


Cost


The prescribed fee, made payable to the Business Affairs Branch, must be paid when lodging the registration form. For current fees view the fee schedule on the payments page.

Registration Period

Bills of sale are registered for a period of four years.

If you wish to have the Bill of sale continue beyond this four year period, you should complete the form Statutory Declaration for Renewal of Registration of a Bill of Sale prior to the date the original bill of sale is due to expire.

If you wish to remove the Bill of Sale prior to the date of expiry, you will need to complete the form Certificate of Satisfaction.  See the page on Satisfying a Bill of Sale for information on this process.

Endorsed Copies

If a photocopy of the bill of sale contract is lodged with the registration form (Statutory Declaration Verifying Particulars of a Bill of Sale), the contract should be marked "A" and endorsed as follows;

This is the annexure marked "A" referred to in the attached statutory declaration declared before me....

A Justice of the Peace or Commissioner for Declarations should certify this statement.

Acknowledgement of Registration

Business Affairs does not send notification that a bill of sale has been registered, nor does Business Affairs notify you when a bill of sale is due for renewal.

If you require for your records the bill of sale number and registration date, please forward another copy of the bill of sale document (additional to the copy attached to the statutory declaration) when lodging the bill of sale.  Please ensure that ALL copies are certified and clearly show that duty has been paid.

When the bill of sale has been registered, the original bill of sale document will be returned to you stamped with a registration number and date.

The bill of sale will be due for renewal prior to the expiry of the four-year registration period.
